RecallNest Terms and Conditions

1. Acceptance of Terms

By downloading, installing, or using RecallNest ("the Application"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use the Application.

2. Service Description

RecallNest is a mobile study application based on the SM-P spaced repetition algorithm, designed to facilitate personal learning through:

• Creation and management of study flashcard decks
• Adaptive spaced repetition scheduling powered by the SM-P algorithm
• Card-level progress history tracking
• Support for text, audio recordings, and images on both sides of each card
• Optional encrypted local backups to protect your data
• Fully offline functionality — no internet connection required

3. License to Use

You are granted a limited, non-exclusive, non-transferable, and revocable license to use RecallNest exclusively for your personal, non-commercial use, in accordance with these Terms and Conditions.

3.1. Restrictions

You agree NOT to:

• Modify, adapt, translate, or reverse engineer the Application
• Decompile or attempt to extract the source code of the Application
• Use the Application for illegal or unauthorized purposes
• Distribute, sublicense, rent, or sell the Application
• Remove, alter, or obscure any copyright or proprietary notices

4. User Data Ownership

RecallNest is designed with the principle of complete user data control:

• All your data remains on your device — the Application works completely offline
• We do not collect, store, or transmit your study data to any server
• You are the sole owner of all cards, content, and data you generate
• You can back up your data at any time using the Application's optional backup feature
• Backup files are stored locally on your device or in a location of your choosing, and are never accessible to the developer

5. Backup and Password Protection

The Application offers an optional backup feature that allows you to export your data (decks, audio, images, and study progress) as a local file. You may optionally protect this backup file with a password of your choice.

• The backup password is set and managed exclusively by you
• The password is never transmitted to the developer or any third party
• The developer cannot recover or reset your backup password
• If you forget your backup password, access to that backup file may be permanently lost

Recommendation: Keep your backup password in a safe place and create backups regularly to avoid data loss.

6. User Content

You are solely responsible for the content you create, store, and manage within RecallNest, including:

• Study flashcards and their text content (front and back)
• Attached audio recordings
• Attached images
• Deck organization and structure

You must ensure that all content you enter into the Application:

• Does not infringe copyrights, trademarks, or other intellectual property rights
• Does not contain illegal, defamatory, obscene, or inappropriate material
• Complies with all applicable laws and regulations

7. Privacy and Data Protection

RecallNest deeply respects your privacy:

• No personal data collection — we do not request or store personally identifiable information
• No tracking — we do not use third-party analytics or tracking tools
• No internet connection required — the Application works completely offline
• Local data only — all information is stored exclusively on your device via SQLite

8. Updates and Modifications

Rohyller Pereira Albarran reserves the right to:

• Update, modify, or discontinue Application features
• Modify these Terms and Conditions at any time
• Release new versions of the Application

Significant updates to these terms will be notified by updating the "Last updated" date and, when appropriate, through in-app notifications.

9. Disclaimer of Warranties

RecallNest is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of uninterrupted or error-free operation
• Warranties of specific learning outcomes

Important: RecallNest is a personal study tool. The developer does not guarantee specific academic results nor is responsible for how the user utilizes the study content.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Rohyller Pereira Albarran shall NOT be liable for:

• Loss of data stored locally on your device
• Loss of access to backup files due to a forgotten password
• Direct, indirect, incidental, special, or consequential damages
• Loss of profits, revenue, or data
• Business interruption or loss of opportunities

Recommendation: We advise you to regularly back up your data using the Application's backup feature and to keep your backup password safe.

11. Indemnification

You agree to indemnify and hold harmless Rohyller Pereira Albarran from any claim, loss, liability, damage, cost, or expense (including reasonable attorney fees) arising from:

• Your use of the Application
• Your violation of these Terms and Conditions
• Your violation of third-party rights, including intellectual property rights
• Content you create or store in the Application

12. Jurisdiction and Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Portugal, without giving effect to any principles of conflicts of law.

Any dispute related to these terms shall be subject to the exclusive jurisdiction of the courts of Portugal.

13. Termination

You may stop using RecallNest at any time simply by uninstalling the Application from your device. Uninstalling the Application will remove all locally stored data unless you have previously created a backup.

Rohyller Pereira Albarran reserves the right to terminate or suspend your access to the Application if you violate these Terms and Conditions.

14. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a competent court, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Rohyller Pereira Albarran regarding the use of RecallNest.
